All images/media on this website are copyrighted by Kaylee DeCollibus. Unauthorized use, reproduction, or distribution of these images/media without proper permission is strictly prohibited and may violate the Digital Millennium Copyright Act of 1998 (17 U.S.C. §512(c)). Violation of these rights may lead to legal action.

Real Estate Photo licensing agreement

Kaylee DeCollibus Real Estate Photography maintains the copyright for all digital images created during the course of business and displayed on this website. The real estate broker/agent (referred to as "CLIENT") who commissions the photography is granted a license to use the property images, for which they have made payment, solely for promoting that specific property across any media while the CLIENT manages the listing. This license will expire once the property is Sold, Expired, or Withdrawn. Any editing or alteration of the images, apart from minor cropping and/or resizing, is strictly prohibited unless conducted by the PHOTOGRAPHER.


The CLIENT is not permitted to give, license, or sell the images to any third party, including the property owner, other brokers/agents/Realtors, builders, architects, stagers, or any other vendors. Failure to comply with these terms will result in copyright infringement/violation under the Digital Millennium Copyright Act of 1998 (17 U.S.C. §512(c)), which may lead to legal action. The PHOTOGRAPHER acknowledges that the CLIENT has no control over how the images are shared by MLS and syndicated to other property listing websites (such as Zillow, Trulia, etc.).


The PHOTOGRAPHER reserves the right to re-license real estate images for commercial use by developers, builders, designers, vendors, or other interested parties. However, such re-licensing will only occur through a separate agreement between the PHOTOGRAPHER and the licensee.


Property Condition

To ensure a successful photography session, the CLIENT is responsible for ensuring that the listing is clean and prepared at the scheduled time. The PHOTOGRAPHER's role primarily involves capturing images and may involve minimal adjustments such as window coverings, small item placement, or light control as necessary. However, the PHOTOGRAPHER is not responsible for furniture relocation.


It is the responsibility of the CLIENT to maintain a safe environment for the photographer, free from any potential hazards. Additionally, the CLIENT must ensure that any pets are appropriately confined and out of view during the session.

Please note that the PHOTOGRAPHER will not retouch images to conceal known defects or physical structures such as wall or floor blemishes, driveway cracks, power lines, and similar elements unless specifically requested to be addressed prior to listing.


In addition to these guidelines, it is expected that lights will be turned on, cars will be removed from the driveway, window shades will be raised, and umbrellas (if applicable) will be opened. If the client is unable to be present on-site, the photographer will handle these adjustments. Rest assured, upon completion of the session, all adjusted elements will be returned to their original state, as found before the session began.

Payment


Payment is due on or before the date of the appointment, unless you choose to mail a check. In the case of payment by check, invoice reminders will be sent until the checks are received. Once payment is received, you will be issued a receipt for your records.

Floorplans

Please note that the floorplans provided are approximate and intended for general reference purposes only. While we strive for accuracy, they may not represent exact measurements or dimensions. It is advisable to verify specific details and measurements with a qualified professional or relevant sources. We cannot be held responsible for any discrepancies or inaccuracies in the floorplans.

Additional Terms

The finalized images are securely backed up by Kaylee DeCollibus Real Estate Photography and can be re-delivered upon request within 90 days from the original delivery date. Please note that beyond this timeframe, the availability of the photos cannot be guaranteed. To ensure uninterrupted access to the images throughout the listing duration, it is strongly advised that the Client creates a local backup of the files.


Once the Client's contractual agreement with the homeowner concludes (whether due to property sale or transfer to another agent), the license for image usage also expires. Consequently, the Client should delete their backup files at that point in time to align with the expiration of the license.
